These terms govern your use of Codidea's software agency services, website, and the OptimPOS product.

Use of the service
By accessing our site or engaging Codidea, you agree to use our services lawfully and in good faith. You must not attempt to interfere with our systems, misuse our deliverables, or use our work in a manner that violates applicable laws or third-party rights.
Intellectual property
Unless otherwise agreed in a written statement of work, Codidea retains ownership of its pre-existing tools, frameworks, and know-how. Upon full payment, the client receives a license or assignment of rights to the project deliverables as specified in the contract. All website content, trademarks, and materials remain the property of Codidea or its licensors.
OptimPOS — Data Collection and Notifications
OptimPOS is a Codidea product designed for point-of-sale management. To operate, OptimPOS collects sensitive data from the end users of the business that contracts it, including phone numbers and email addresses. This data is used exclusively for: (1) sending notifications and commercial communications via WhatsApp Business Cloud API, and (2) sending invoices and payment receipts by email. The client (business) implementing OptimPOS is responsible for obtaining explicit, free, and informed consent from their end users before registering their data in the system, in compliance with applicable data protection laws.
Use of WhatsApp Business Cloud API
Codidea uses the WhatsApp Business Cloud API provided by Meta Platforms, Inc. to send messages through OptimPOS. By using this service you agree that: (1) messages are only sent to users who have given prior consent; (2) use is subject to WhatsApp's Business Policy and Meta's Terms of Service; (3) Codidea is not responsible for changes in Meta's policies that affect the availability of the messaging service; (4) it is prohibited to use the service to send spam, misleading content, or materials that violate WhatsApp's policies. Client Responsibility for Third-Party Data
The client contracting OptimPOS warrants that they have legal authorization to register and process the data of their end users. Codidea acts as data processor and the client as data controller. The client shall indemnify Codidea against any claims arising from breach of this obligation. End users may request deletion of their data at any time by contacting contact@codidea.com or visiting our data deletion page.
Limitation of Liability
Codidea shall not be liable for indirect, incidental, or consequential damages arising from the use of its services. Codidea's total liability shall not exceed the amount paid by the client in the last 12 months. Codidea does not guarantee uninterrupted availability of third-party services such as WhatsApp Business Cloud API or email providers.
